Aetare – Legal Disclaimer & Terms of Service

Aetare (“Company,” “we,” “us,” or “our”) provides custom diamond-creation services using carbon extracted from human or animal hair. By submitting hair samples and using our services, you acknowledge and agree to the following terms.

  • Hair samples must be clean and free of external contaminants (dirt, oils, styling products, dyes, etc.). Inadequate preparation may reduce carbon yield or affect diamond quality.
  • We make commercially reasonable efforts to extract and purify carbon, but we do not guarantee a minimum carat weight from any given sample.
  • If insufficient carbon is extracted, we will contact you to discuss options (e.g., combining with another sample, using a different process, or canceling the order with a partial refund).
  • The final diamond’s color, clarity, and carat weight depend on the quality, quantity, and chemical composition of the hair provided. Slight variations in size, hue, and brilliance are normal and do not constitute a defect.
  • Every Aetare diamond is submitted to the International Gemological Institute (IGI) for independent grading and certification.
  • The IGI certificate is issued by an independent third-party laboratory. We do not control their grading standards, turnaround times, or final grades.
  • Important: Each diamond is unique due to the individual composition of the source material. The final diamond may fall anywhere within the entire IGI grading range. We do not guarantee a specific color, clarity, or cut grade.
  • IGI certification is included as part of our service.
  • Aetare offers laser engraving on the diamond’s girdle (waist) with a combination of up to 10 digits or alphabet characters of your choice.
  • The engraved text will also appear on the IGI certificate in the comments or inscription section.
  • Disclaimer: We make every effort to ensure the engraving is accurate and matches your request. However:
    • We are not responsible for typographical errors in the request you submit.
    • Once the engraving is completed, it is permanent and cannot be altered or removed.
    • If you wish to change the engraving after submission, additional fees and processing time will apply.
    • We do not guarantee that the engraving will be visible to the naked eye; it is typically only visible under 10x magnification.
  • You represent and warrant that:
    • You own the hair submitted or have explicit legal permission from the owner (or the owner’s estate/legal representative) to use it for diamond synthesis.
    • The hair does not come from an endangered or protected species and was obtained lawfully and humanely.
  • We reserve the right to refuse service for any sample we reasonably believe is stolen, illegally obtained, or from a prohibited source.
  • We do not verify the identity or species of the hair origin; you are solely responsible for accurate disclosure.
  • Each order is assigned a unique tracking code to ensure the carbon source is never mixed with any other client’s material.
  • Upon delivery, you will receive documentation confirming the chain of custody and carbon source traceability.
  • However, due to the nature of the carbon extraction and purification process, no biological material (including DNA) remains in the final diamond. The final product is pure crystallized carbon.
  • Hair samples undergo multiple high-temperature, high-pressure, and chemical treatments. There is a small risk of complete carbon loss or sample destruction.
  • In the event of loss or irreparable damage, our liability is limited to:
    • Re-processing with a new sample (if available), or
    • A refund of the service fee (excluding shipping costs).
  • We are not responsible for sentimental or consequential damages.
  • Diamond growth typically takes 4-6 months depending on size, color, and lab conditions.
  • Estimated completion dates are approximate. We are not liable for delays caused by equipment maintenance, supply chain issues, lab schedules, or force majeure events (natural disasters, pandemics, etc.).
  • All Aetare diamonds are custom-made, one-of-a-kind products. Once production begins, cancellation, refund, or return is not permitted.
  • We offer a limited warranty against manufacturing defects (e.g., cracks or inclusions caused by our processing errors) for 7 days from delivery.
  • This warranty does not cover:
    • Normal variations in color, clarity, or carat weight.
    • Chips, scratches, or damage caused by setting, resizing, or everyday wear after delivery.
    • Damage caused by third-party jewelers.
  • To claim warranty, you must return the diamond in its original sealed packaging with proof of purchase.
  • To the maximum extent permitted by law, our total aggregate liability for any claim arising from our services (whether in contract, tort, or otherwise) shall not exceed the total fees paid by you for that specific order.
  • We are not liable for:
    • Emotional distress, sentimental loss, or reputational harm.
    • Any indirect, incidental, special, or punitive damages.
    • Claims arising from third-party jewelers’ settings, modifications, or resale of the diamond.
    • The accuracy or interpretation of IGI grading or certification.

You agree to indemnify and hold harmless Aetare, its owners, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Breach of your representations regarding ownership or consent for the hair.
  • Misrepresentation of the hair’s origin (e.g., claiming human hair when it is animal, or vice versa).
  • Any violation of applicable local, state, federal, or international laws relating to animal or human biological materials.
  • This disclaimer and all transactions shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China , without regard to conflict-of-law principles.
  • Any dispute shall first be submitted to non-binding mediation; if unresolved, it shall be resolved exclusively by the courts of the Hong Kong Special Administrative Region of the People’s Republic of China.

By submitting hair to Aetare, you acknowledge that you have read, understood, and agreed to this entire disclaimer. If you do not agree, please do not submit samples or place an order.
